Dear Mohtram Qasmi sb. As-Salam-o-Alaikum WRWB.
I have the following query about Zakah. Please clarify.Someone has paid down payment & some installments for a planned flat on some floor in some planned building, yet to be built. The flat is expected to be built in 2010 & installments to continue till a few years after completion/handover of the flat. Will Zakah be due every year on the total amount paid (as down payment & installments) at the time of zakah calculation, if, a) The intention is to rent out the flat once built & pay zakah on its rental income? b) The intention is to sell the flat with profit? c) The intention is to live in the flat themselves? Please clarify for all the above three cases.

Yes, in all the three cases, the Zakat will be due every year on the total amount one has deposited. After completion of the building, when you will have owned the flat, in the first case, the Zakat will be due on its rental income and in second case, Zakat will be due on its total amount and in the third case, there will be no Zakat. your intention today does not have any effect on the rule.
