i am a 57yr old post menopausal and my husband is terminally ill since last yr and he has told me not to observe iddat if he dies .what should be my course of action in this very unhappy situation. i am a gynaecologist by profession

Dear Sister in Islam,

The answer to your question is as follows:

Islam enjoins wife to listen to and obey her husband as long as his obedience does not entail the disobedience to Allah Subhanahu Wa Ta¡¯ala.

Observing the Iddah of widowhood is Wajib for every wife¡ªyoung or old, whose husband has passed away leaving her behind widow. Allah Subhanahu Wa Ta¡¯ala says in the Glorious Qur¡¯an, ¡°If any of you die and leave widows behind; they shall wait concerning themselves four month and ten days¡­¡± (Surtul-Baqrah 2: V: 234)

Since not observing the Iddah of widowhood leads to the disobedience to Allah and the violation of Divine Law, you are not obliged to listen to your husband in this regard. You will have to observe the Iddah of widowhood¡ªfour month and ten days, when he leaves for heavenly abode. During the Iddah period you will not be permitted to go out of the house where you will be observing the Iddah expect in the case of extreme necessity where there is no choice but to go out. However, you will have to spend night in that house. (Hedayah 2: 410, Raddul Muhtaar 2:674)
