Question By : Arshad Javed

Assalam o alaikum,
I am married. I have just married another divorced girl who was spending her Iddat. Because of people¡¯s pressure, I divorced her. Then someone told me that this nikah which was done in iddat was not valid, so talaq was also invalid. Therefore, I married her after she had completed her iddat period. Now my question is that is this nikah (second time) valid and according to Shariah or it requires Halala. One thng more I want to share that there is no body to take care of her nor her family nor any other. According to shariah how could she be helped? Waiting for your reply. Arshad Javed, India. The answer to your question is as follows:

Your Nikah (first time) with the divorced girl who was spending her Iddat (prescribed period) was unlawful and invalid and so is the case with Talaq. Therefore, the Nikah (second time) done after the completion of her Iddat is valid and according to Sari¡¯ah. Hence, there is no need to do Halala. And it is now your responsibly to look after her completely. (And Allah knows best) (Shamee: V 5, Pg 157)
